Toxtails 2025

1. General 1.1. These Terms and Conditions ("Terms") govern participation in the online charity auction ("Auction") hosted by Toxtails by Port Medical Aesthetics Clinic ("Organiser"). 1.2. By registering and participating in the Auction, bidders agree to abide by these Terms. 1.3. The Auction is conducted to raise funds for Liberty Domestic & Family Violence Specialist Services. All proceeds, minus applicable costs, will go to the this charity.

2. Registration and Participation 2.1. Participants must be at least 18 years old to register and bid. 2.2. Registration requires providing accurate contact details, including name, email, and phone number. 2.3. The Organiser reserves the right to refuse or cancel a registration at its sole discretion.

3. Auction Process 3.1. The online Auction will end before the live auction, closing at 5 PM on March 1st, the day of the event. 3.2. Final bids will be entered on the bidders' behalf on the night of the live event. 3.3. If you are present on the night and wish to bid higher, you may do so, which will override the original bid online. 3.4. Bidding will open and close at the times specified by the Organiser. Late bids will not be accepted. 3.5. Each bid placed is a binding contract. Participants cannot retract bids once submitted. 3.6. The highest valid bid at the close of the Auction wins the item.

4. Payment and Collection 4.1. Winning bidders will be notified by the end of March 1st or the next day to process their payment. 4.2. Payments can be made via credit card via our stripe facility. 4.3. Failure to make payment within the specified period may result in forfeiture of the item, which may be offered to the next highest bidder. 4.4. Items must be collected or delivery arranged within 5 days of payment confirmation. 

5. Item Descriptions and Condition 5.1. All items are sold "as is" without warranties or guarantees unless explicitly stated. 5.2. The Organiser makes every effort to accurately describe auction items. However, they are not liable for discrepancies, misinterpretations, or condition issues.

6. Cancellations and Refunds 6.1. All sales are final. No refunds or exchanges will be permitted unless required by law. 6.2. If an item becomes unavailable due to unforeseen circumstances, the Organiser will provide a suitable replacement or refund at their discretion.

7. Liability and Indemnity 7.1. The Organiser is not responsible for any loss, damage, or personal injury related to participation in the Auction or the use of purchased items. 7.2. Participants agree to indemnify and hold harmless the Organiser from any claims, damages, or expenses arising from their participation.

8. Privacy 8.1. Participant information will be used solely for Auction-related activities and will not be shared with third parties except as necessary for processing payments and item delivery. 8.2. By participating, bidders consent to their names being published if they win an item unless they request otherwise in writing.

9. Amendments and Disputes 9.1. The Organiser reserves the right to modify these Terms at any time. Changes will be shown here - https://airauctioneer.com/toxtails-2025. 9.2. Any disputes arising from the Auction shall be resolved at the sole discretion of the Organiser, and their decision is final.

By participating in the Auction, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
