1. Event Details • Auction opens 11 August 2025. • Auction closes Thursday 9 October 2025. • Bidding will end at 5:00 PM (AEST) on Thursday 9 October 2025. 2. How to Bid • No credit card details required; all bids are binding and final upon placement. • Bids can only be placed through Air Auctioneer, accessible via the URL provided. • Live bid status updates are visible. • Starting big and bid increments are set. 3. Winning & Payment • The highest bid at closing time wins. • Winners will receive an invoice by email within 24 hours of auction close. • Full payment via invoice must be received by Friday 17 October 2025. • No funds are collected or held by the bidding platform. • If payment isn’t received by COB Friday 17 October 2025, the item may be re-auctioned or awarded to the next highest bidder. 4. Collection of Artwork • Winning bidder may collect the artwork from Friday 24 October onwards. Details for collection/drop off will be arranged with the Mawambul team following payment of invoice. 5. Auctioned Artwork & IP Rights • Gavin Kelly, (the Artist), owns all rights in and to the Artwork including, without limitation, all intellectual property rights and ICIP • The winner of the auction will be entitled to physically possess and own the physical Artwork, however, all rights in and to the intellectual property rights and ICIP in the Artwork will continue to vest in the Artist. Non-Exclusive Licence: The Artist grants Mawambul a non-exclusive licence to copy, use, reproduce, adapt, modify, communicate, distribute and publish the Artwork for the following purposes: (a) promotion and marketing of the one-year celebration event for Mawambul, including reproducing a print version of the artwork on the invitations for the event; (b) production of a limited edition run of merchandise featuring the Artwork with all proceeds from the sale of the merchandise being donated to The Living Country, ABN 88 676 718 808 20 Seventh St Weston NSW, 2326, Australia; and displaying the Artwork at the one-year celebration event for Mawambul. • Attribution to Artist, Gavin Kelly, will be given wherever practical. • Any uses other than the above require prior negotiation with the Artist. 6. Disclaimers & Liability • All artwork is offered "as-is". • Mawambul, the Artist, and the platform accept no liability for damage, loss, or defects. • Bidders participate at their own risk. • Profits from this auction will be donated to The Living Country, ABN 88 676 718 808 20 Seventh St Weston NSW, 2326, Australia. 7. Privacy & Conduct • Participant data (name, email, bid amount) is collected for auction administration and invoicing. • Data will not be shared or used beyond auction purposes and legal requirements. • Bidders agree to behave respectfully and follow the event’s code of conduct. 8. Changes & Cancellation • Mawambul reserves the right to withdrawal, modify, or void any bid at its discretion. In the event of disputes, Mawambul’s decision is final.
