AUCTION TERMS AND CONDITIONS General Auction Terms All sales are conducted by Seacoast Utility Authority. By participating in the auction, all bidders agree to comply with these rules and procedures. “AS IS – WHERE IS” Sale All items are sold AS IS, WHERE IS with no warranties, guarantees, or representations of any kind—express or implied. This includes, but is not limited to, implied warranties of merchantability or fitness for a particular purpose. Buyers are strongly encouraged to inspect all items prior to bidding. No claim will be considered after the sale, regardless of the nature or extent of any defect. No Returns or Refunds ALL SALES ARE FINAL. There will be no refunds, returns, or exchanges for any reason. Buyer’s Responsibility for Removal Buyers are solely responsible for the removal, transportation, and loading of all purchased items. All items must be removed by the specified deadline provided at the time of the auction or in the auction listing. Any item not removed by the deadline may be considered abandoned, and the buyer may forfeit ownership without refund. Seacoast Utility Authority is not responsible for providing equipment, tools, labor, or assistance in the removal of purchased items. Inspection and Due Diligence It is the buyer’s responsibility to inspect and verify the condition, authenticity, and value of the item prior to placing a bid. No adjustments will be made after the auction. Payment Terms Payment is required in full before any purchased item may be removed. The following forms of payment are accepted: ACH Transfer (Drawn from customer account, ACH form returned and signed.) Bank Check / Certified Check, Cash Wire Transfer All payments must be made by the deadline specified in the auction terms. Cash sales over $10,000 must be reported to the IRS using Form 8300, Report of Cash Payments over $10,000. Form 8300 reporting applies to individuals, companies, corporations, partnerships, associations, estates, and trusts. The information required to complete Form 8300 will be requested at the time the payment for the sale is received. Buyers may be required to present identification for verification. Default and Forfeiture Failure to pay or remove items within the required time frame may result in forfeiture of the item and any payments made. The Seacoast Utility Authority reserves the right to resell the item and/or pursue legal remedies for breach of contract. Seacoast Utility Authority’s Rights Seacoast Utility Authority reserves the right to: Reject any bid at their sole discretion. Resolve any disputes between bidders. Withdraw any item from the auction at any time. Cancel the sale of any item prior to issuance of a paid receipt. Acknowledgement Participation in this auction constitutes acknowledgment and acceptance of these rules and procedures. In the event of a tie, where two or more bidders place the same highest bid at the same time, the item will be re-auctioned. The re-auction will begin with the starting bid equal to the amount of the tied highest bid. All bidders are bound by these terms, whether bidding in person, online, or by proxy.
