Auction terms and conditions
Peter Nutt | Art Studio Balzers
By participating in an auction on this platform, you (the "Bidder" or "Buyer") agree to the following terms and conditions. These terms ensure a transparent and professional process for the acquisition of original works by Peter Nutt.
1. Auction Management

Seller Identity: All auctions are conducted by the artist, Peter Nutt, based in Balzers, Liechtenstein.

Auction Administration: This platform and all administrative auction processes are managed and operated by Lian Ospelt on behalf of Peter Nutt. He is responsible for the technical operation, coordination of bids, and primary communication with bidders through the dedicated email auktion@peternutt.com.
2. Pricing and the "10% Administration Fee"
The total purchase price for an artwork consists of the following:

The Hammer Price: The final winning bid amount at the close of the auction.

Administration Fee: A mandatory fee of 10% will be added to the Hammer Price. This fee covers the organizational costs, digital platform maintenance, global marketing, and the management services provided by Lian Ospelt.

Taxes: Any applicable statutory Value Added Tax (VAT) or local taxes will be added where required by law.
3. Shipping and Delivery
The Hammer Price and the 10% Administration Fee do not include costs for packaging, shipping, or insurance.

In-House Logistics: To ensure the highest level of care, Peter Nutt Design personally manages the professional packaging and coordinates the delivery of all artworks.

Individual Calculation: Due to the unique dimensions and weight of Peter Nutt’s sculptures, as well as the variety of international destinations, shipping costs cannot be standardized. These are calculated individually for each order.

Separate Invoicing: The Buyer will receive a separate invoice for packaging and shipping once the auction has concluded and the final destination is confirmed.

Collection: If the Buyer prefers to collect the artwork personally from our studio in Balzers, Liechtenstein, he may do so by prior appointment. In this case, shipping fees will be waived. Should he choose to pick up the piece himself, he still has the option to have the Peter Nutt Anstalt professionally package the artwork for safe transport.
4. Bidding and Contract Conclusion

Binding Offers: Every bid submitted is a legally binding offer.

Conclusion of Sale: The contract is concluded when the auction timer expires and the highest bidder is notified.

Payment Terms: The total amount (Hammer Price + 10% Administration Fee) is due within 7 business days. Artworks will only be dispatched once all invoices (including shipping) are settled in full.
5. International Customs and Duties

For deliveries outside of Liechtenstein or the Swiss Customs Union, the Buyer is solely responsible for all import duties, customs fees, and local taxes levied by the destination country.
6. Authenticity and Condition

Material Character: The use of industrial materials and aviation relics is an intentional artistic choice. Natural patinas or irregularities are part of the work’s character.

Context Imagery: For your convenience, the first image provided in each lot listing is a digital visualization generated using artificial intelligence. This image is intended solely for illustrative purposes to assist you in conceptualizing how the artwork may appear within a furnished environment. Please be aware that this image is not a photograph of the actual object in a physical space and does not represent the item's scale, finish, or texture in a real-world setting. All bidders are encouraged to rely on the subsequent photographs and technical descriptions provided for the actual item for their due diligence.
7. Liability

The studio maintains insurance for the artwork until it is handed over to the shipping carrier. Upon handover, the risk of loss or damage transfers to the Buyer.
8. Final Provisions

Governing Law: These terms are governed by the laws of the Principality of Liechtenstein.

Jurisdiction: The place of jurisdiction for all disputes is Vaduz, Liechtenstein.

Self-Collection: Available by appointment at the studio in Balzers, Liechtenstein. In this case, shipping and standard packaging fees are waived.
Note: Artworks will be dispatched only after all costs (including shipping) have been paid in full.
