These terms and conditions (the "Agreement") govern your participation in the auction conducted by Taylor Morrison, Inc. ("Auctioneer"). By participating in the auction, you agree to be bound by these terms and conditions.

1. Registration: a. By registering, you have agreed to receive updates regarding this and future auctions in accordance with the Terms and Conditions and Opt Out features of the respective privacy policies of Taylor Morrison, Inc. and AirAuctioneer. b. To participate in the auction, you must register by providing accurate and complete information as required by the Auctioneer. c. You must be at least 18 years old to register and participate in the auction. d. The Auctioneer reserves the right to refuse or revoke registration at its discretion.
2. Bidding: a. Bidders may place bids on items offered in the auction. b. Bids are considered binding offers and cannot be retracted. c. The highest bid acknowledged by the Auctioneer shall be the winning bid. d. The Auctioneer may establish bidding increments and reserves the right to refuse any bid.
3. Auctioneer's Discretion: a. The Auctioneer has the sole discretion to: - Determine the order of bidding. - Reject any bid that is not in the best interest of the auction. - Withdraw any item from the auction before or during bidding.
4. Payment: a. Payment for items won must be made in accordance with the payment terms specified by the Auctioneer. b. Acceptable payment methods may include cash, certified check, credit card, or other methods as determined by the Auctioneer. c. All payments are due promptly upon winning an item.
5. Buyer's Premium: a. A buyer's premium may apply to all winning bids, as specified by the Auctioneer.
6. Inspection and "As Is" Condition: a. Items are sold "as is," without warranties or guarantees of any kind. b. Bidders are encouraged to inspect items before bidding.
7. Removal of Items: a. Buyers are responsible for the removal of items within a specified time frame after the auction. b. Any costs associated with the removal and transportation of items are the responsibility of the buyer.
8. Dispute Resolution: a. In the event of a dispute between bidders, the Auctioneer's decision shall be final. b. Any legal disputes arising from the auction shall be resolved in accordance with local laws.
9. Liability: a. The Auctioneer is not responsible for any injuries, damage, or loss that may occur during the auction. b. Bidders assume all risks associated with participating in the auction.
10. Changes to Terms and Conditions: The Auctioneer reserves the right to amend or modify these terms and conditions at any time, with notice to registered bidders.
11. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Arizona.
