Adelaide Fringe auction terms and conditions

By bidding in the Adelaide Fringe warehouse auction, each bidder agrees to these auction rules:

1. The sale is final. There will be no exchanges or refunds unless otherwise noted. All items are “as is.” Adelaide Fringe has attempted to describe and catalogue items correctly, but does not warrant nor represent and in no event shall be responsible for the correctness of descriptions, genuineness, authorship, provenance or condition of the items. No statement made in this auction or elsewhere, shall be deemed such a warranty, representation, or assumption of liability.
2. The Auction will be open between 4pm on the 31st of August and close at 4pm on the 11th of September. Adelaide Fringe reserves the right to either extend or shorten the duration of the auction. 
3. The highest bidder on the close of the auction will be taken to be the successful bidder (the ‘Purchaser’) and will be taken to have entered into a binding contract for the purchase.
4. Adelaide Fringe’s preferred payment method is through Stripe via the air auctioneer website. 
5. The purchaser must collect their items from the Adelaide Fringe Warehouse (location given to winners) between these dates and times;
   1. Tuesday 15th of September between 9:30am – 4pm
   2. Wednesday 16th of September between 9:30am – 4pm
   3. Thursday 17th of September between 1pm – 9pm
   4. Friday 18th of September between 9:30am – 4pm
   5. Saturday 19th of September between 9:30am – 4pm

There will be no refunds or exchanges for items not collected within this period. Items not collected within this period will be offered for sale to the second highest bidder.

6. It Is the responsibility of the purchaser to arrange all necessary transport of the item(s) from the Adelaide Fringe warehouse including extra crew to assist with large items where a forklift cannot be used.

7. Adelaide Fringe reserves the right to add or withdraw auction items without notice, to or from the auction and retains absolute discretion to accept or reject any bids.

8. Each person bidding assumes all risks and expenses related to the auction and items obtained at the auction from the time the auction concludes. Except for any liability that cannot be excluded by law, Adelaide Fringe (including its officers, employees, agents and volunteers) excludes all liability for any personal injury, or any loss or damage, whether direct, indirect, special or consequential, arising in any way out of or in connection with the auction. Adelaide Fringe excludes all liability for any indirect or consequential loss or damage to the extent permitted by law. Adelaide Fringe will collect each bidder’s personal information for the purpose of conducting the auction (including for identifying and notifying the successful bidder).

9. Adelaide Fringe reserves the right to refuse any bid without declaring a reason. In such an event, Adelaide Fringe may negotiate with any interested party. Adelaide Fringe does not give or imply any warranty on items offered. Value indicated alongside item description, on any hard copy or electronic collateral shall be regarded as recommended retail or estimate only. Values are not warranted by the Adelaide Fringe.
