From beginners to professional artists, The Sophie Clarke Foundation's Charity Art Exhibition shines light on the big and small things we should all love about life.

This auction is fundraising for The Sophie Clarke Foundation's charity partners, Sound Minds and PAPYRUS. By partnering with existing charities, The Sophie Clarke Foundation is working to make a real difference to the lives of those struggling with their mental health. The Foundation believes that as a society we need to go beyond saying "It's ok not to be ok" and start to act in a way that demonstrates this.

Auction terms and conditions

The Sophie Clarke Foundation’s (“TSCF”) Love Life Auction Terms & Conditions. 

By entering a bid for any piece of artwork featured on this website, whether as part of the online silent auction or as part of the live auction, you are agreeing to the below terms and conditions. These terms and conditions may be amended at any time at TSCF’s sole discretion.

Much of the artwork featured on this website can be viewed live at the Love Life Art Exhibition being held at Twentytwo, 22 Bishopsgate, London EC2N 4AJ between 8 November 2021 and 17 November 2021.Please see item descriptions to identify those pieces of artwork that will form part of the exhibit and reserve free tickets for the exhibition here: lovelifeartexhibition.eventbrite.co.uk

All artwork has been gifted to TSCF to sell at auction to raise funds for charity. Details of the charities that will benefit from the funds raised at auction are listed on TSCF’s website and are available on request from TSCF.

1. Bidding

1.1. All artwork featured on this website is to be sold via online silent auction with the exception of 19 pieces, all of which have been marked (Artwork Title**). Bids on these 19 pieces can only be made at the live auction to be held at Twentytwo, 22 Bishopsgate, London EC2N 4AJ on Wednesday 17 November 2021. If you would like to bid on any of these pieces and are not attending the Live Auction, please contact thesophieclarkefoundation@gmail.com by Monday 15 November. 

1.2. To make a bid on any other piece(s) of artwork please follow the instructions on the website. 

1.3 The online silent auction will run from 19:00 on Monday 1 November 2021 to 18:00 on Sunday 21 November 2021, unless automatically extended 15 minutes as a result of last minute bids. Bids received after such time will not be valid.

1.4 By placing a bid for any piece of artwork, you are making an irrevocable offer, capable of acceptance by TSCF, to purchase the item at the stated bid price.

1.5 The highest bid for each piece of artwork as accepted by TSCF will be deemed to be the winner, whereupon such bidder will (a) assume the risk and responsibility with respect to the relevant piece and (b) will pay the full purchase price in accordance with the terms below.

1.6 In the unlikely event that an entry error with respect to the bid price has occurred, please contact thesophieclarkefoundation@gmail.com promptly (but in any event within 24 hours of such bid) to discuss the retraction of such bid. In such circumstances, TSCF reserves the right to award the item to the second highest bidder.

1.7 All sales are final and there will be no exchanges or refunds.

1.8 TSCF reserves the right to add or withdraw items, without notice, to or from the auction.

2. Winning Bidders: Paying for and Collecting your art

2.1. The online silent auction will end at 18:00 on Sunday 21 November 2021 at which point the highest bidder will ‘win’ and will be obligated to purchase their artwork. For the avoidance of doubt, the decision of the winner for each piece of artwork will be at the good faith discretion of TSCF and such decision will in all cases be final. In the event of any dispute between bidders, TSCF shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the lot in dispute. If any dispute arises after the sale, the sale records of TSCF shall be conclusive in all respects.

2.2. Artwork in the exhibition: See item description to check if the artwork you wish to bid on is featured in the Love Life Art Exhibition and not in the Live Auction. On receipt of payment (which must be made within 5 working days of the confirmation from TSCF of the successful bid), TSCF will contact you via email to arrange for you to collect your artwork from 23 Killieser Avenue, London, SW2 4NX at a mutually convenient time. We would be happy to discuss any alternative arrangements for collection or delivery by mutual agreement.

2.3. Artwork not in the exhibition: TSCF will contact the artist to arrange delivery of the purchased artwork. As part of this, you acknowledge and agree that your contact and mailing details will be provided to the relevant artist. 

2.4. Live Auctioned Art: Payment will be taken on the evening of the live auction. The purchaser will take their artwork on the evening, unless other arrangements are agreed at that time.

3. Limit of Liability

3.1. TSCF has endeavoured to fairly represent, both visually and by description, the artwork being offered in the online silent auction. Notwithstanding the foregoing, TSCF neither warrants nor represents, and in no event shall be responsible for, the correctness of descriptions, genuineness, or condition of any items in either the live or online silent auction.

3.2. Each piece of artwork is sold “as is” with all faults and imperfections and errors of description. TSCF does not take responsibility for any damage that may occur in transporting any such artwork to the purchaser, nor shall it offer any refunds once art has been purchased, not least because net proceeds of both the live and online silent auction are to be donated to TSCF partner charities. 

3.3. TSCF will use its reasonable efforts to work in good faith with any successful bidder to rectify any problems that occur, without creating any legal obligation for them to do so.

3.4 Each bidder agrees to hold harmless from any liability arising out of the Love Life Art Exhibition and related auction processes TSCF, its trustees and any other persons affiliated with TSCF.

4. Data Protection

4.1 “Data Protection Laws” means the UK Data Protection Act 2018, General Data Protection Regulation (2016/679/EC) (GDPR) and all applicable laws and regulations relating to processing of personal data and privacy, including any guidance and codes of practice issued by the Information Commissioner from time to time.

4.2 TSCF respects your privacy and is committed to protecting your personal data. TSCF processes personal data in accordance with Data Protection Laws and will use your data as set out in the privacy policy accessed here: https://www.thesophieclarkefoundation.com/privacy-policy

These terms and conditions, as well as relevant parties’ respective rights and obligations hereunder, will be governed by and construed and enforced in accordance with the laws of England and Wales. By bidding, each person shall be deemed to have consented to the exclusive jurisdiction of Courts of England and Wales.

Items in this auction may be subject to an undisclosed reserve price. Item prices which do not meet the reserve are marked . Should the leading bid at expiry not meet the reserve price, the item will not be sold.
